Acceptable Use Policy

What may be sold on a Farm-to-Porch Co. storefront, and how operators are expected to behave. Part of the operator agreement.

Who this applies to

This policy applies to every business licensed to run a storefront on Farm-to-Porch Co. (an "operator"), and to everyone who accesses that storefront under the operator's account — its staff, drivers, suppliers, and customers. Operators are responsible for the conduct of all of them.

It forms part of the Software as a Service License Agreement between us and each operator. Breaking it is a breach of that agreement.

Goods that may not be sold

Storefronts exist to sell farm and food products. The following may not be listed or sold, regardless of local law:

  • Alcohol, tobacco, nicotine, vaping products, cannabis, hemp-derived THC, and CBD intended for consumption.
  • Prescription drugs, and supplements or remedies marketed as treating, curing, or preventing any disease.
  • Meat, poultry, or seafood that has not been processed under the applicable federal or state inspection program, where inspection is required.
  • Raw or unpasteurized milk and products made from it, anywhere its retail sale is not lawful, and never across state lines.
  • Home-canned low-acid foods, home-produced products requiring a licensed kitchen where the producer holds no such licence, and anything else sold outside the operator's or supplier's cottage-food or processing authorization.
  • Wild game, foraged mushrooms sold without a certified identification expert, and shellfish from uncertified waters.
  • Live animals, weapons and ammunition, hazardous or explosive materials, and controlled substances.
  • Counterfeit, stolen, recalled, expired, or adulterated goods, and anything the operator or supplier is not lawfully entitled to sell.

Honest listings

Product descriptions, images, prices, weights, and availability must be accurate, and must reflect the item the customer will actually receive.

Claims about origin, growing practice, and certification must be true and substantiated. Do not describe a product as organic, grass-fed, pasture-raised, wild-caught, non-GMO, or locally grown unless it qualifies, and do not use a certification mark you do not hold.

Allergen, ingredient, and nutrition information must comply with the labeling law that applies to the product. Do not make health or medical claims about food.

Running the marketplace fairly

  • Fulfill the orders you accept, or refund them promptly. Do not take payment for stock you do not have.
  • Handle refunds, substitutions, and complaints in line with what your storefront tells customers.
  • Pay your suppliers what they are owed, on the schedule you agreed with them.
  • Do not discriminate against customers or suppliers on any basis protected by law.
  • Hold the licences, permits, registrations, and insurance your business requires, and keep them current.

Customer and supplier data

The people who use your storefront trusted you with their details. Use them only to run your business on this platform.

  • Do not sell, rent, or trade customer or supplier data, and do not disclose it except as your own privacy notice permits.
  • Send email only to people who requested access, placed an order, or otherwise asked to hear from you. Never use purchased or scraped lists.
  • Honor unsubscribe requests and deletion requests without delay.
  • Do not export data from the platform in order to market unrelated products or services.

Payments

You collect payment through your own account with a payment processor, under your own agreement with them. You are responsible for complying with that agreement, including its list of prohibited and restricted businesses.

  • Process only genuine sales made through your own storefront. Never run transactions for another business, or for goods sold elsewhere, through your account here.
  • Do not use the platform to give cash advances, transmit money, or process anything that is not a sale of the goods you list.
  • Do not evade chargebacks, or pressure customers out of disputing a charge they are entitled to dispute.

Using the software

  • Do not probe, scan, or test the security of the platform, or try to reach data belonging to another operator.
  • Do not scrape the platform, run automated bulk requests against it, or circumvent rate limits, usage caps, or access controls.
  • Do not upload viruses, malware, or any other harmful code.
  • Do not share login credentials. Every person who needs access gets their own account.
  • Do not impersonate anyone, or misrepresent your relationship with a supplier or a certifying body.
  • Do not resell, sublicense, or white-label the platform, or use it to build a competing product.

How we enforce this

We would rather talk to you than switch anything off, and for most problems we will contact you first and give you a chance to put it right.

Where the risk is serious — a safety issue, a legal violation, a threat to other operators on the platform, or conduct that puts our payment processing at risk — we may remove a listing, suspend an account, or suspend the storefront immediately, as the agreement permits.

To report a listing or an operator you believe breaks this policy, contact us and include the storefront address and what you saw.

Changes

We may update this policy as the platform and the law change. We will tell operators about material changes, and continued use of the platform after a change means the revised policy applies. The version in force is always the one on this page.
